The regulatory framework for the insurance and reinsurance sector is becoming increasingly more complex and industry players continuously struggle with tougher competition. Companies need to balance service, price and customer satisfaction with claims and risk management strategies to limit their exposure in insurance underwriting and security for underperforming policyholders.
The Monetary Authority of Macau is the supervisory authority of the insurance activity in the jurisdiction and is in charge of coordinating and inspecting this sector, issuing licenses, regulating the industry and dealing with disciplinary matters. Both foreign and domestic companies are authorized to operate in the local insurance market for life-insurance or non-life-insurance businesses, pursuant to certain legal requirements.
We offer legal advice and services on a broad spectrum of insurance and reinsurance matters, including insurance and reinsurance, regulatory, operational and risk analyses and advice; agency and intermediary agreements; negotiating, drafting, reviewing or advising on the enforceability of all types of insurance and reinsurance documentation, including policies, employment and service agreements, private pension funds and regulation handbooks; insurance litigation and dispute resolution, including negotiation and settlement of claims, employment and agency related disputes and disciplinary matters; assisting with and advising on the legal requirements and license application for operation in the Macau SAR for insurance and reinsurance companies and for the intermediary sector; tax planning; and financing for insurance companies.
