C&C Lawyers respects your privacy and this Privacy Policy describes who we are, what purposes we use your data for, how we process them, who we share them with, and how long we store them. It also informs you about how you can contact us and exercise your rights.

WHO ARE WE?

Your data will be processed by C&C – Law Offices Management Company Limited (“C&C Lawyers” or “we”), with head office at Avenida da Praia Grande, 759, 3 FL, Macau SAR.

C&C Lawyers is the data controller for purposes of Law 8/2005, of 22 August of Macau SAR on Personal Data Protection, and within the meaning of the General Data Protection Regulation of the European Union.

WHAT ARE THE PURPOSES AND THE LEGAL GROUNDS FOR THE PROCESSING OF YOUR PERSONAL DATA?

C&C Lawyers will only process your personal data when:

  1. We have a legitimate interest in doing so, namely to contact you or provide information in connection with services previously provided or to respond to your enquiries (“contact us” form). We process your personal data based on our legitimate interest in providing you a personalized and quality service, and, as applicable, for the adoption of necessary pre-contractual procedures or the rendering of our services to you as our Client;
  2. We have obtained your consent to process your personal data for specific, explicit and legitimate purposes, such as providing legal information, legislation updates or relevant events organized by C&C Lawyers or third parties (“newsletter subscription” form or pages in social networks); and/or
  3. It is necessary to comply with our legal obligations or to exercise or sustain a legal claim, based on our legitimate interest in defending C&C Lawyers’ rights.

In each case, C&C Lawyers will only process your data provided that our interest complies with the applicable legislation and does not interfere with your rights. 

WHAT CATEGORIES OF PERSONAL DATA DO WE PROCESS?

When you fill in the forms made available on our site, your data, such as your name, email address, company name, job title, telephone number or address is collected by C&C Lawyers and processed in order to respond to your questions and requests or to provide you with information.

If you register for one of our events, some of your personal data may be shared with the entities organizing the event in question and/or with other participants.

If you provide us with your contacts, C&C Lawyers may contact you for marketing purposes relating to its services, provided you have consented to the processing of your personal data for this purpose. If you do consent, you will receive marketing communications by email or our pages in social networks. However, you may object to this data processing at any time.

Your consent is essential for C&C Lawyers to be able to process your personal data for the purposes described above. However, if you choose not to give your consent, your visit to and use of our site will not be affected.

If you are our Client additional personal data may be required for the purposes of client contact management, rendering of services and invoicing, such as contact details, language, identification document, tax payer number, and bank account details.

HOW LONG DO WE STORE YOUR INFORMATION?

Our policy is to store your data only for the period and necessary to fulfil the purposes for which they were collected. However, in certain cases, we may store the data for longer periods when the law requires us to do so.

The time limit during which we retain your personal data may vary depending on the purpose for which they were collected and processed. Therefore, we will retain your personal data within the following time limits:

  • Sending of commercial communications: until you withdraw your consent;
  • Reply to your contact requests: until the moment that personal data are no longer necessary for the fulfilment of these purposes;
  • To comply with legal obligations: for the time required to comply with the legal obligations applicable in each case;
  • Exercise or defense of legal claims regarding personal data: Until the date on which the dispute in question has become final, or until the date of the settlement of the claim.

In case personal data are used for various purposes that require us to retain them within different time limits, we will apply the longer time limit.

TO WHOM DO WE COMMUNICATE YOUR PERSONAL DATA?

We do not sell, distribute or make your information commercially available in any way, to any third party outside of the C&C Group of companies (Who We Are), except in fulfilment of the legal obligations or in cases where such communication becomes necessary for the provision of our services.

C&C Lawyers may contract external service providers, acting as subcontractors, to send you our newsletters. For that purpose, we follow rigorous criteria in the selection of service providers in order to comply with the data protection obligations and execute a data processing agreement, which includes, among others, the following obligations: apply appropriate technical and organizational measures; process personal data for the purposes agreed upon; respond exclusively to our documented instructions; and erase or return personal data to C&C after such services are completed.

Your personal data may be communicated to countries outside of the Macau SAR, which data protection legislation may not provide equivalent protection to that conferred within the Macau SAR. In such cases, in addition to ensuring that your personal data will always be processed in accordance with what is stated in this privacy policy, we will undertake measures to make such transfer compliant with applicable legislation and put in place safeguards, with respect to the protection of your privacy, fundamental rights and freedoms, equivalent to those offered within the Macau SAR.

For data subjects located in the EU, the legal ground for the transfer of your personal data to a processor located in a country outside of the European Economic Area (EEA) is that the processor is a certified entity under the Privacy Shield Framework. In practice, this means that our processor is considered a safe recipient of personal data by offering an adequate level of protection, as determined by the European Commission. When you provide us your explicit consent to send you newsletters, you acknowledge and accept that you are also providing your unambiguous and explicit consent for the cross-border transfer of your personal data in the above mentioned conditions.

WHAT ARE MY RIGHTS?

At any time, you may:

  1. Have access to the information we maintain on you. As the data subject, you have the right to obtain confirmation of whether or not the data that relates to you are being processed or not and, if they are, to access your data and the information provided for by law.
  2. Ask for the rectification of the information if it is inaccurate or incomplete. As the data subject, you have the right to require C&C Lawyers to rectify any inaccurate or incomplete data referring to you without undue delay.
  3. Ask for the erasure of your personal data. As the data subject, you have the right to ask C&C Lawyers to erase your data without undue delay, and C&C Lawyers is required to erase your data without undue delay for any of the following reasons:
    1. The personal data are no longer necessary for the purpose for which they were collected or processed;
    2. You withdrew your consent to the data processing (in cases in which the processing is based on consent) and there is no other ground for the processing in question;
    3. You object to the processing and there are no overriding legitimate interests that justify their processing.
  4. Ask for restriction of processing of your personal data. As data subject, you have the right to ask C&C Lawyers to restrict the processing of your data where one of the following situations applies:
    1. You contest the accuracy of the personal data, with a restriction for a period enabling C&C Lawyers to verify its accuracy;
    2. The processing is unlawful, and you oppose the erasure of the personal data and request the restriction of their use instead;
    3. C&C Lawyers no longer needs your personal data for the purposes of the processing, but you require them to establish, exercise or defend a right in a legal claim;
    4. If you have objected to the processing, pending the verification whether the legitimate grounds of the controller prevail over your grounds.
  5. Where personal data are processed for direct marketing purposes, you have the right to object at any time to processing of personal data concerning you for such marketing, which includes profiling to the extent that it is related to such direct marketing.

If you object, C&C Lawyers will no longer process the personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or that the processing is necessary for the establishment, exercise or defense of legal claims.

  1. If the processing depends on your consent, you have the right to withdraw that consent at any time.

However, the right to withdraw consent does not affect the lawfulness of any processing based on the consent initially given up to the point of its withdrawal. It also does not affect the subsequent processing of the data based on another legal ground, for example, in the case of compliance with a contractual obligation or with any legal requirements to which C&C Lawyers is subject.

You have the right to make a complaint before a competent data protection supervisory authority.

DO WE HAVE ANY TYPE OF SECURITY AND CONFIDENTIAL MEASURES?

We are committed to keeping your data secure and confidential. For that purpose we use appropriate security measures to ensure your personal data are protected and to prevent access to them by unauthorized persons. We periodically analyze our security systems and policies in order to ensure that your data are safe and protected, in accordance with this Privacy Policy and with the applicable legislation. However, the transmission of data over the Internet is not completely secure and we cannot provide an absolute guarantee of the security of the information transmitted through our site.

To exercise your rights, you must attach a copy of a document proving your identity. You also must indicate the right you intend to exercise. The exercise of your rights is free of charge.

In certain cases, for example as a result of legal requirements, your request may not be dealt with immediately. In any case, you will be informed of the measures taken to deal with your request within one month of the date the request is made.
